NEW DELHI: The Supreme Court collegium headed by Chief Justice D Y Chandrachud recommended the Centre to elevate Chief Justice of Allahabad
HC Justice Rajesh Bindal and Chief Justice of Gujarat HC Justice Aravind Kumar to the peak court and told the federal government that five
names which were earlier recommended and pending its approval shall have precedence over these 2 names and they be informed first.Under
attack from various government authorities including the law minister who openly criticised the collegium system of appointment of judges
for being non-transparent and nontransparent, the collegium gave the factors for choosing the names for elevation and criteria adopted by it
to shortlist the names in an effort to infuse more transparency.On the line of issue recently expressed by Supreme Court in court procedures
about the Centre selecting and picking names from numerous suggestions and disturbing seniority of judges, the collegium consisting of CJI
and Justices Sanjay Kishan Kaul, K M Joseph, M R Shah, Ajay Rastogi and Sanjiv Khanna in its recommendation said the five names suggested
earlier by the collegium on December 13 will have precedence over the two names recommended currently
Therefore, the consultations of five judges recommended on 13 December 2022 needs to be alerted independently and previously in point of
time before the two judges recommended by this resolution, the collegium said in its recommendation.As per the collegium recommendation
published in SC site, all six members were unanimous for the elevation of Justice Bindal, but Justice Joseph expressed his booking on
Justice Kumars elevation on the ground that his name can be thought about at a later stage.Justice Bindal stands at Sl
No 2 in the combined All-India-seniority of high court judges and is the seniormost judge coming from the Punjab and Haryana HC
While advising his name, the Collegium has actually thought about the truth that the Punjab and Haryana HC which is one of the largest High
Courts with a sanctioned strength of eighty 5 judges is not sufficiently represented on the Bench of the Supreme Court, it said.Justice
