The Government of Nepal has actually enacted the Criminal activity Victim Relief Fund Regulations to supply relief or settlement to persons victimised by criminal offenses.

As per the regulations, there shall be a five-member steering committee headed by a registrar of the Supreme Court.

Its members include joint secretaries at the Ministry of Law, Justice and Parliamentary Affairs, Ministry of House Affairs and Ministry of Women, Children and Senior Citizens, and Judgment Execution Directorate of the apex court.

The committee will open an account in any & lsquo; A & class commercial bank and deposit the amount gotten for the ‘fund.

Guideline 8 of the guidelines mentions that the committee shall allocate necessary amount to the district court worried for supplying relief or compensation to the victims of criminal offences.

If a court has passed an order to offer relief or settlement to a criminal offense victim from the fund, such a victim will submit an application to the court concerned to receive the prescribed quantity.

It needs the culprit worried to deposit the amount in the fund as purchased by the court within 35 days of the verdict.

Even if the wrongdoer is not economically efficient in paying the payment purchased by the court and the transgressor has yet to be identified, the victim will get relief or settlement from the fund.

In a case where the wrongdoer does not supply the victim with the compensation quantity ordered by the court to be given to the victim, the court will assist the victim by recovering the amount from the movable or immovable home of the culprit.

According to guidelines, relief or settlement will be provided on the basis of physical and mental injury meted out to the victim apart from medical expenditures, damage to property, costs sustained for hiring legal representative and effect on income generation capability of the victim, to name a few.

If the victim dies, his/her next of kin will get the prescribed quantity.

In case, the damaged home can not be brought back to its original kind, the quantity of compensation shall be ordered to be paid according to the dominating market value of such home.
