Patan High Court ordered former lawmaker Gayatri Sah and her husband, Rajesh Mahato, to take custody of their child from Mediciti Hospital and appear before the court with their child within three days.
Shah had given birth to a baby with Down syndrome on March 12 at the hospital but had refused to take custody of the child, saying the doctors did not reveal to her the childmedical condition when the child was in her womb.
The order was issued by Patan High CourtRegistrar Baburam Dahal based on an order passed by a division bench of Patan High Court judges Kumar Gautam and Tek Narayan Kunwar.
On October 17, the bench had ordered Dahal to issue appropriate order with regard to the custody of the child, on the basis of recommendation by the Medical Board. &Division bench of Gautam and Kunwar asked me to issue an order in the best interest of the child and as the Medical Board wrote to us saying the child could be discharged from the hospital, I issued the order to Sah and her husband to appear before the court, with the child,& Dahal said.
The couple was arrested on May 5, on the charge of abandoning their newborn at the hospital, but were later released by a court order.
Mediciti Hospital had filed a writ petition against Sah and her husband under ChildrenAct, for abandoning the baby.
The couple had been staging protest on the hospital premises accusing the hospital of lying about the infanthealth condition while in the motherwomb, during their routine checks.
Down syndrome is a genetic condition where children show some level of intellectual disability, a distinct appearance and some health and developmental challenges.
During the protest, they alleged that doctors had lied to them saying the infant inside the womb was ‘completely healthy&. The hospital management has, however, defended itself saying it was not possible to diagnose the exact health condition of the foetus in Nepal.

Out of ten surgeries for fractures, one surgery is conducted for osteoporosis on a daily basis in Nepal Orthopaedic Hospital, Jorpati.
Osteoporosis is a bone disease in which the density and quality of bones are reduced, said Mukti Timilsina, consultant orthopaedic surgeon at Nepal Orthopaedic Hospital.
Data provided by National Trauma Centre revealed that out of 64 osteoporosis patients visiting the hospital daily, 52 were women.
&The bones constantly dissolve and construct themselves till the age of 30. But after thirties, bones start breaking down and there is not much reconstruction happening. It results in brittle bones, which is susceptible to fractures, mainly on the spine, hips and wrist,& added Timilsina. Women were more susceptible to osteoporosis, said the doctor. Menopause, lifestyle and dietary behaviours were important factors for the health of bone in women. A rise in thyroid hormone has also been identified as the cause of osteoporosis in women.
A research conducted over a duration of six months from October 2017 to March 2018 by Timilsina and his team, which was published as ‘Association of Lifestyle and Food Consumption with Bone Mineral Density among People Aged 50 Years and Above Attending the Hospitals of Kathmandu, Nepal& on May 2019, in the Journal of Osteoporosis, had concluded that high prevalence of osteoporosis was found in women.
An analytical cross-sectional study conducted among 169 people of age 50 years and above, who underwent Dual Energy X-Ray Absorptiometry scan in the hospitals of Kathmandu valley revealed that the prevalence of osteoporosis, osteopenia, and normal bone mineral density was 37.3 per cent, 38.5 per cent, and 24.2 per cent, respectively. Out of 63 patients, 54 women were found to have suffered from ostereoporosis, according to the research.
Osteoporosis was positively associated with age and smoking, the research revealed. The bones in women start toweaken after menopause. &After menopause there is reduction in the estrogen hormone which isresponsible for bone protection, making women vulnerable to osteoporosis. As there is less calcium deposition in the body, bones in womenbodies break from a fall, even from sneezing or minor bumps,& he added.
&With ageing, people start losing bone density,& said Dipendra Pandey, osteoporosis physician at National Trauma Centre.
Women mostly come to the hospital only when they encounter fracture of bones, said Pandey.
Food and sedentary lifestyle too are blamed for brittle bones among women. To keep their bones healthy, women must consume foods rich in calcium and vitamin D. Calcium and vitamin D supplements can also be taken, suggested doctors.
Osteoporosis was found to be significantly associated with sex, age, smoking habit, and daily calcium consumption. Therefore, women must consume nutritious food and exercise regularly, advised Dr Timilsina. Sitting under the sun is necessary for women as sunlight is a source of vitamin D. It is necessary for calcium absorption, according to Pandey.
World Osteoporosis Day is observed worldwide on October 20, to raise awareness about the prevention, diagnosis and treatment of the disease.

Kathmandu District Court has released Lawmaker Parvat Gurung on general date today.
Gurung, a lawmaker of the ruling Nepal Communist Party (NCP), from Dolakha district has been facing an attempt to murder charge. Judge Pundeshwor Prasad Upadhaye issued the order to release him on general date.
Birdhoj Khadka, a former Maoist cadre, had filed an FIR accusing Gurung of attempting to kill him in Kathmandu, two years ago, during local election campaign. Kathmandu District Courthad issued an arrest warrant against the lawmaker on September 25, following a complaint by Khadka.
During the local election campaign two years ago, Kul Bahadur Tamang, a cadre of erstwhile CPN-UML, was killed in a clash between cadres of the erstwhile UML and CPN-Maoist Centre.
A murder case was filed against 40 local leaders and cadres, including UML leader Devi Khadka and CPN-MC leader Ganga Karki. Birdhoj Khadka, one of the accused in the murder, was brutally beaten up allegedly by UML cadres in Gaushala, Kathmandu. Following the attack Khadka filed an FIR at Metropolitan Police Range, Teku, accusing Gurung of masterminding the attack.

Chairperson of the committee Prof Dr Ram Chandra Gautam was quoted in the Rastriya Samachar Samiti as saying, &11:55 am is the most auspicious time for the same.&
The Tihar festival will be celebrated from October 25 to October 29 this year.
The Kaag (crow) Tihar falls on October 25, Kukur (dog) Tihar on October 26, Laxmi Puja on October 27, Govardhan Puja, Gai Puja and Mha Puja on October 28 and Bhai Tika on October 29.

Kathmandu District Court today extended former speaker Krishna Bahadur Maharapolice custody till October 23.
Mahara was arrested on October 6 after Parliament Secretariat employee Roshani Shahi accused him of attempt to rape.
Kathmandu District Court Judge Babu Ram Subedi extended Maharacustody after the second arraignment hearing today. Senior advocate Raman Shrestha, along with four other advocates, are defending Mahara in the court.
KDC had sent Mahara to police custody for 13 days, which ended yesterday. Police produced him today at the court as yesterday was a public holiday.
Mahara recorded his statement at the Government AttorneyOffice, Kathmandu, for nearly seven hours before he was presented at the court today. Chandra Kanta Khanal, joint attorney of Kathmandu District AttorneyOffice said, &We completed recording the statement of the accused, but we may record his statement again, if necessary.&
Mahara was taken to the Government AttorneyOffice in Kathmandu on October 15, but he did not record his statement citing his legal right to remain silent.
Mahara, who is undergoing treatment at Thapathali based Norvic Hospital for high blood pressure and respiratory ailments, was brought from there for necessary court proceedings and was taken back to the same hospital after his arraignment.
Mahara was hospitalised a few days after he was arrested on the charge of attempt to rape.
Police had arrested Mahara from his official residence in Baluwatar on October 6 after Kathmandu District Court issued an arrest warrant in his name the same day.
Roshani Shahi, a nurse at the Parliament Secretariat, had lodged a first information report against Mahara on October 4. Shahi told Metropolitan Police Circle at Baneshwor that Mahara had attempted to rape her and had also brutally beaten her on September 29 in her rented room at Tinkune.
On September 30, Shahi told an online portal that Mahara had raped her. She said Mahara had come to her room with a bottle of whisky despite her objection and forced her to drink it and thrashed her before raping her. She had also said Mahara had sexually harassed her for years.
Mahara resigned from the post of speaker after the ruling Nepal Communist Party instructed him to resign as speaker and member of Parliament.
SSP Uttam Raj Subedi of Metropolitan Police Circle said investigation was in the final stage. &As Mahara has recorded his statement, we might need a few more days to investigate the case. We will soon file a charge-sheet at the court through the District AttorneyOffice,& SSP Subedi said.
If the court denies bail and sends him to jail, Mahara won&t be able to receive his pay and perks as a lawmaker.
