The National Human Rights Commission has expressed concern about deteriorating condition of freedom of movement and freedom of expression in the country.

Incidents of preventing Nepali Congress leader Minendra Rijal from attending a programme in Tanahun and attack on Gyanendra Shahi in Chitwan recently have posed threat to citizens& right to freedom of movement and freedom of expression, the rights body said.

The National Human Rights Commission reminded the government that the Universal Declaration of Human Rights-1948, and the constitution had guaranteed the right to freedom of expression, assemble peaceably, and the right to reside in any parts of the country.

&The NHRC observes that these incidents have violated the fundamental rights of citizens, but the government has yet to express its commitment towards guaranteeing these rights in future,& read a press release issued by the rights body today. The governmentapathy to bring to book the perpetrators of these incidents has raised serious question on its commitment to good governance and human rights in the country.

&Lack of seriousness on part of the government on freedom of movement and freedom of expression is not good for any country. Therefore, the NHRC urges the government to create an environment where citizens can enjoy their right to freedom of peaceful assembly, movement and expression without fear,& the release stated.

The National Human Rights Commission has also called on the government not to ‘hijack the fundamental rights of citizens under any pretexts. &The NHRC requests the government to bear all expenses incurred during for the treatment of Shahi and initiate action against the guilty, by conducting a fair investigation into the incident.

KATHMANDU: Speaker Krishna Bahadur Mahara has resigned from his post following an accusation of rape by a staff of the federal parliament secretariat, until the end of investigation.

The secretariat of Nepal Communist Party (NCP) had met earlier today and decided that Mahara should resign from the post of Speaker of the House of Representatives.

Spokesperson of the ruling party, Narayan Kaji Shrestha told THT Online that the secretariat meeting held earlier today has decided that Mahara will stepdown from the post of Speaker to facilitate investigation following the accusation. Additionally, Mahara will no longer remain a Member of Parliament.

&In a bid to facilitate factual, fair and independent investigation into allegations levelled at my character, I hereby submit my resignation on moral grounds until the end of the investigation process,& Mahara said in a press statement issued this afternoon.

The news of rape surfaced after hamrokura.com published a report on September 30, where the woman has accused Mahara of raping her in her own residence. The victim (whose identity has not been disclosed) said that Mahara came to her rented apartment located at Tinkune in an inebriated state on Sunday evening and raped her.

Meanwhile, the press advisor of Krishna Bahadur Mahara, Dilli Malla, had released a press release on Monday, rebutting the allegation.

Kathmandu, September 30

Police have arrested a group of five persons for allegedly murdering their friend Kamala Karki, 55, of Kapilvastu district, on September 18 in Karkirented house at Tenzing chowk, Kapan.

Karkideath was shrouded in mystery when police found her body in her room with her hands and mouth tied with a shawl. The mystery, however, unfolded after police nabbed Somlal Thing of Makwanpur, Pasang Tamang of Okhaldhunga, Pasang Tamang of Rautahat, Pasang Sherpa of Okhaldhunga and Ram Krishna Karki from Bouddha area. They had allegedly murdered their friend with the intention of swindling her.

Deputy Superintendent of Police Hobindra Bogati said all of them were friends and occasionally used to gather at one anotherroom to party. On the night of the murder, the five had planned on getting Karki drunk and looting the money and gold she owned.

&After Karki lost consciousness, the five began robbing the gold she was wearing and her money at her place, but she regained consciousness. The scared friends then used the shawl to strangulate her to death,& DSP Bogati said. She had also severely bitten one of her friends, who was trying to take off her gold chain.

They had looted four gold rings, the gold chain Karki was wearing along with Rs 45,000 from her room.

Nepal Medical Council has sought clarification from Grande International Hospital and the doctors involved in the treatment of Sanjeev Neupane and Ekta Ghimirechild.

The council sought clarification after reports submitted by a committee of experts headed by Professor Ganesh Rai pointed out that three major mistakes were made by the hospital in the treatment of the baby.

Overdose of paracetamol was administered to the baby and there was a misunderstanding between the radiologist and neurosurgeons on the size of hydrocephalus — a condition in which excess cerebrospinal fluid builds up within the ventricles (fluid-containing cavities) of the brain, according to the committee. The committee also pointed out that CT scan or MRI of the patient had been delayed against the suggestion of the radiologist.

The baby was born at the hospital on 26 June 2018. It was kept in the neonatal intensive care unit half-an-hour after his birth. Later, the baby was infected with klebsiella bacteria and had to undergo five surgeries.

The council said no humanitarian concern had been shown even when the health condition of the baby was critical.&We have asked for clarification from the hospital and the doctors involved in the treatment of the baby, after the report revealed glaring mistakes in the treatment procedure,& said Dhundi Raj Paudel, a NMC member.

The council said the mistakes of the hospital were against the code of conduct of the council.

Therefore, the neurosurgeons and paediatricians involved in the treatment of the baby should be recommended for punishment, it stated.

According to the accuser, Mahara used to visit her residence in the past also as her husband (who was out of the town on Sunday) had a close association with him. She claimed that Mahara had brought alcohol and snacks alongwith and started drinking in her room, while persuading her to join him.

She alleged that Mahara then forced himself upon her and when she tried to stop him, he physically abused her.

Hamro Kura‘s investigation also claims that Mahara&s reading-glasses which were broken in the brawl was found in the stafferhouse along with the sole of his shoe.

In a secured audio which THT Online received, the woman claims that Mahara had called her saying he would visit her place. She said, she tried to stop Mahara from visiting her place but he didn&t listen to her and arrived under the influence of alcohol. She said that she called the police for help after Mahara forced himself upon her but they arrived only after he had left the scene.

Similarly, in a video released by Hamro Kura, the woman claims that she has known Mahara for years and that he had shown indecent behaviour in the past as well. She also stated that she had submitted a written application regarding Maharaindecent behaviour in 2073 BS to the then Speaker of the Constituent Assembly of Nepal, Onsari Gharti Magar.

Speaker denies involvement

Meanwhile, the press advisor of Krishna Bahadur Mahara, Dilli Malla, released a press release on Monday, rebutting the allegation.

The allegations against the Speaker are unwarranted, fabricated and grave and we ask all to disregard the false rumour, reads the statement.

It adds that the reported ‘misbehaviour& by the speaker can not be imagined and has been spread to damage the reputation and credibility (character assassination) of the speaker.

According to the statement, Speaker Mahara had reached his office in Singha Durbar at 12:00 on Sunday afternoon and had been there till 2:00. He returned to his residence afterwards and had been there since, further refuting the claims regarding the Speakereffects such as his reading glass and shoe sole being present at the incident site.

The press advisor further claims that Speaker Mahara has his glasses with him and that he does not wear shoes with such a sole that was found in the accusorhome.

The staffer, who accuses the Speaker, was dissatisfied with him after he refused to interfere with adjustment of the civil servants working in the Secretariat, the statement further argues.

It is written that the Speaker was shocked and sad by the false accusation against him. The release claims that this a planned conspiracy against him to assaniate his character and damage his personal and political reputation by bringing forth a ‘puppet.&

Meanwhile, when THT Online contacted Metropolitan Police Circle, Baneshwar, which also handles the cases of Tinkune, the office refused to provide concrete information regarding the case. The Circle said that the victim has yet to file a report and that they can carry out an investigation to the case only after that.

Gagan Thapa, an opposition party leader, has suggested the Speaker to step down from his position so that the authorities can conduct a fair investigation.

Scores of people staged a protest at Maitighar Mandala expressing solidarity with anti-corruption campaigner Gyanendra Shahi, who was allegedly attacked by the cadres of Nepal communist Party (NCP) on Saturday in Chitwan.

The protesters accused the government of unleashing terror and trying to gag those who spoke against the government.

Speaking to THT during the protest programme, Surendra Bhandari, a senior advocate, said the government had resorted to state terror after failing to control his anti-corruption campaign.

&The ruling party used its cadres to attack Shahi after it failed to silence him through legal means,& Bhandari said.

Shahi was pulled into controversy after he confronted Minister of Culture, Tourism and Civil Aviation Yogesh Bhattarai for delaying a Kathmandu-bound flight from Nepalgunj earlier this month, the video of the confrontation was widely shared on social media.

Shahisupporters said that after the confrontation inside the flight,a group of people had misbehaved with him at a press meet at Reporterclub in Maitighar.

He was again ill-treated by the same group of people at another press meet held in Lalitpur on September 15.

Shahi was then taken into custody by police from the press meet citing security concerns. Although released on the same day, he was again manhandled at his own office in Pulchowk a few days later.

Several other speakers at the protest programme said that attack on Shahi was simplya reflection of the governmentfrustration after it failed to deliver and keep the promises made during elections.

Members of the anti-corruption campaign have decided to file a case against the people involved in the attack with Metropolitan Police Range, Teku, tomorrow.
